Environmental Compliance Approval (Air/Noise)

Under Section 9 of the Environmental Protection Act no person shall, except under and in accordance with an Environmental Compliance Approval (ECA), formerly known as a Certificate of Approval prior to October 31, 2011, issued by the Director, construct, alter, extend or replace any plant, structure, equipment, apparatus, mechanism or thing that may discharge a contaminant into any part of the natural environment. The definition of a contaminant includes noise and vibration. Hence, Section 9 of the Act requires companies or individuals to obtain a C of A for Air and Noise prior to constructing, altering, or operating equipment at their facilities.

Some examples of equipment that may require an Environmental Compliance Approval include, but are not limited to the following:
 
 
An Environmental Compliance Approval (ECA/CofA) is required to operate, install or modify such a facility or equipment.  Approval is also required for the ongoing operation of any equipment that may discharge a contaminants to the atmosphere.
